These Terms of Use (“Terms”) govern access to and use of the websites, applications, and online services provided by Bovisen, LLC (“Bovisen,” “we,” “us,” or “our”), including any hosted cloud services, dashboards, APIs, and related offerings (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Scope of Services
The Services include:
- Our public website and informational content; and
- Our cloud software and IoT services that collect device, operational, and usage data.
If you or your organization enters into a separate written agreement with Bovisen (such as a master services agreement, evaluation agreement, or order form), that agreement will govern to the extent it conflicts with these Terms.
Changes to These Terms
We may modify these Terms from time to time. Changes become effective upon posting, as reflected by the “Last updated” date. Continued use of the Services constitutes acceptance of the updated Terms.
Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.
Accounts and Access
Certain features may require an account.
You agree to:
- Provide accurate and complete information;
- Maintain the confidentiality of your credentials; and
- Notify us promptly of any unauthorized access.
You are responsible for all activity conducted under your account.
Acceptable Use
You will not:
- Access or use the Services in violation of applicable law;
- Interfere with or disrupt the integrity or performance of the Services;
- Attempt to gain unauthorized access to systems or data;
- Reverse engineer or decompile the Services except as permitted by law; or

Intellectual Property
The Services and all related intellectual property, excluding Customer Data, are owned by Bovisen or its licensors and are protected by applicable laws.
Subject to these Terms, Bovisen grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for internal business purposes.
Data Rights and Use
Customer Data
“Customer Data” means data submitted to or generated through the Services by or on behalf of you, including device telemetry, sensor data, and operational metrics.
You retain ownership of Customer Data.
License to Operate the Services
You grant Bovisen a non-exclusive, worldwide license to host, process, store, transmit, and use Customer Data as necessary to provide, maintain, secure, and support the Services.
Product Improvement and Analytics
You grant Bovisen the right to use Customer Data to:
- Improve and develop the Services;
- Monitor performance, reliability, and security; and
- Create and use aggregated and/or de-identified data for analytics, benchmarking, and internal business purposes.
Bovisen will not attempt to re-identify de-identified data except as required for security, integrity, or legal compliance.
Personal Information
The Services may collect limited personal information associated with user accounts. Bovisen’s handling of personal information is governed by its Privacy Policy.
Bovisen does not sell personal information.
Feedback
Any feedback or suggestions you provide may be used by Bovisen without restriction or obligation.
Third-Party Services
The Services may integrate with third-party services. Bovisen is not responsible for third-party services, which are governed by their own terms.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOVISEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
BOVISEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.
IN NO EVENT SHALL BOVISEN’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE TOTAL AMOUNT OF FEES, IF ANY, PAID BY THE USER TO BOVISEN FOR THE APPLICABLE SERVICES GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless Bovisen from claims arising out of your use of the Services in violation of these Terms or applicable law.
Suspension and Termination
Bovisen may suspend or terminate access to the Services if reasonably necessary to address security risks, legal compliance, or violations of these Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal action shall be brought exclusively in the state or federal courts located in Dallas County, Texas.
